1. Acceptance of Terms
By accessing or using the Patchwork platform ("Service"), available at patchwork.wtf, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Patchwork ("we," "us," or "our"). By creating an account, accessing the Service, or using any part of the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
Patchwork is a browser-based collaborative code editor that enables real-time collaboration between developers. The Service allows users to:
- Create, edit, and manage code projects within a browser-based development environment
- Collaborate with other users in real time on shared codebases
- Execute code within sandboxed environments provided by the platform
- Share projects publicly or privately with selected collaborators
- Integrate with third-party services including version control systems and deployment platforms
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including the availability of features, databases, or content. We may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
3. Account Registration
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during the registration process
- Maintain and promptly update your account information to keep it accurate and complete
- Maintain the security and confidentiality of your login credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
You may register using your email address and a password, or through supported third-party OAuth providers (GitHub, Discord, or Google). When using third-party authentication, you authorize us to access certain account information from those providers as described in our Privacy Policy.
You must be at least 13 years of age to create an account and use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We reserve the right to refuse registration, suspend, or terminate accounts at our sole discretion, including for violations of these Terms.
4. User Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any illegal or unauthorized purpose, or in violation of any applicable laws or regulations
- Upload, transmit, or distribute any malicious code, viruses, worms, trojans, or other harmful software through the platform
- Attempt to gain unauthorized access to other users' accounts, projects, or any part of the Service's infrastructure
- Use the Service to mine cryptocurrency or perform any computationally abusive activities within sandbox environments
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated scripts, bots, or scrapers to access the Service without our express written permission
- Harass, abuse, threaten, or intimidate other users of the Service
- Upload or share content that is defamatory, obscene, or infringes on the intellectual property rights of others
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity
- Use the Service to store or transmit content that violates export control laws or trade sanctions
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including removing content, suspending or terminating accounts, and reporting violators to law enforcement authorities.
5. Intellectual Property
Your Content
You retain all ownership rights to the code, files, and other content you create or upload through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to host, store, transmit, and display your User Content solely for the purpose of providing and improving the Service.
For projects you make publicly accessible, you acknowledge that other users may view, fork, and interact with your content in accordance with any license you apply to your project.
Our Intellectual Property
The Service, including its original content (excluding User Content), features, functionality, design, and underlying technology, is and remains the exclusive property of Patchwork and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
The Patchwork name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Patchwork. You may not use these marks without our prior written permission.
Feedback
If you provide us with any feedback, suggestions, or ideas regarding the Service, you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use such feedback for any purpose without any obligation or compensation to you.
6. Privacy
Your privacy is important to us. Our collection and use of personal information in connection with the Service is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.
7. Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your right to use the Service will immediately cease.
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:
- A breach of these Terms
- A request by law enforcement or other government authority
- Discontinuation or material modification of the Service
- Unexpected technical or security issues
- Extended periods of inactivity
Upon termination, we may delete your account data and User Content. We recommend exporting your data before requesting account deletion. Certain provisions of these Terms will survive termination, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
8. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that the results obtained from the Service will be accurate or reliable, or that any defects in the Service will be corrected.
You understand and agree that your use of the Service is at your sole risk. No advice or information, whether oral or written, obtained from us or through the Service shall create any warranty not expressly stated in these Terms.
We are not responsible for any loss of data, code, or work product that may result from the use of the Service, including data loss caused by system failures, outages, or bugs. You are solely responsible for maintaining backups of your User Content.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PATCHWORK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to, use of, or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNTS PAID BY YOU TO PATCHWORK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.
10. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page and, for material changes, we will provide additional notice such as an email notification or an in-app announcement.
Your continued use of the Service after any modifications to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may request the deletion of your account.
